Types of legal parts

Parties Involved

First of all, it is important to highlight the parties involved in a legal proceeding in order to clarify the elements of the action.

The parties in a lawsuit are the plaintiff and the defendant. These are the ones who participate in the procedural legal relationship. The procedural relationship is triangular. In this relationship, the parties submit petitions to the judge, and the judge makes the decisions.

Plaintiff

Their main mission within the proceeding is to present evidence that proves the truthfulness of their allegations.

Defendant

This is the person who is subject to the accusations presented by the plaintiff. They must present evidence of their innocence to the judge and may refute the Plaintiff's arguments and even file a counterclaim in their favor (equivalent to a “counter-lawsuit”).

Judge

This is the person vested by the State, responsible for impartially analyzing and judging the issues presented by the plaintiff and the defendant.
